Please read these Terms and Conditions (“Terms”) carefully before using our Site, purchasing products, or engaging our synthetic turf installation, concrete, hardscaping, and vinyl fencing services. By accessing the Site, signing a project agreement, or requesting an estimate, you agree to be bound by these Terms.

1. Scope of Services

American Turf provides synthetic turf installation, concrete and hardscape construction, vinyl fencing installation, and turf maintenance services throughout San Diego County and surrounding areas. All estimates, scope-of-work proposals, and agreements are subject to these Terms unless explicitly superseded by a written master installation contract signed by both parties.

2. Estimates, Site Conditions, & Subterranean Utilities

  • Scope & Pricing: All written quotes and estimates are valid for thirty (30) days from the date issued, unless otherwise stated in writing.

  • Subterranean Conditions: Initial estimates are based on visible surface conditions during inspection. Unforeseen subterranean obstructions—including hidden bedrock, concrete footings, tree roots, unmapped utility pipes, drainage lines, or saturated soil conditions—discovered during excavation, grading, fence post drilling, or slab prep may require additional labor/materials and will result in a price adjustment via a written Change Order.

  • Underground Utility Staking: For fencing and concrete footings requiring deep digging, American Turf will initiate a local utility line locating request (e.g., 811 DigAlert). The property owner remains responsible for identifying and marking all private, unrecorded lines (such as private irrigation, gas lines for outdoor kitchens, pool plumbing, or custom low-voltage lighting).

  • Permits & HOA Approvals: While American Turf provides product specification sheets and design guidance, the property owner is solely responsible for obtaining any required HOA approvals, local municipal building permits, or setback variances unless explicitly itemized and included in the written project scope.

3. Property Lines, Boundaries, & Vinyl Fencing Specifics

  • Property Line Determination: The property owner is solely responsible for identifying exact legal property boundaries and pin locations prior to fence installation or border concrete pours. American Turf installs fences and concrete features strictly according to layout markers agreed upon with the customer. American Turf assumes no liability for disputes, relocation costs, or encroachments arising from incorrect boundary indications provided by the owner.

  • Surveys: If property lines are ambiguous or disputed by adjacent neighbors, the customer is advised to obtain a licensed land survey prior to the start of installation.

  • Fence Heights & Local Codes: Vinyl fence installations must comply with local city height limits and setback codes. Any custom alterations or non-standard height requests made by the property owner are executed at the owner’s sole risk regarding code compliance.

4. Concrete & Hardscape Terms

  • Curing & Color Variations: Concrete is a natural slurry mixture. Minor variations in final color, texture, and surface finish are normal and inherent to concrete placement.

  • Surface Cracking: While American Turf utilizes proper expansion joints, base compaction, and rebar/mesh reinforcement according to industry standards, concrete is prone to hairline cracking due to natural ground movement, temperature shifts, and curing dynamics. Hairline shrinkage cracks do not constitute structural failure or defective workmanship.

  • Weight Restrictions: Newly poured concrete slabs, patios, and driveways require a full cure cycle (typically 7 to 28 days). The customer agrees not to drive heavy vehicles, park machinery, or place extreme point-loads on new concrete surfaces during the recommended curing window provided by the installation crew.

5. Payment Terms & Cancellation

  • Deposits & Progress Payments: A deposit (typically 10% to 50% depending on project scope and local licensing laws) is required upon contract signing to secure scheduling and materials. Progress payments for multi-stage jobs (e.g., demo $\rightarrow$ concrete pour $\rightarrow$ fence/turf install) will follow the draw schedule detailed in your custom agreement.

  • Final Payment: Remaining balances are due immediately upon project completion. Unpaid balances past seven (7) business days will accrue interest at a rate of 1.5% per month (or the maximum allowed under California law).

  • Cancellation: Clients may cancel a signed contract within three (3) business days of signing without penalty. Cancellations made after material orders (e.g., custom vinyl fence orders, turf rolls, or pre-ordered concrete mixes) or crew mobilization will incur restocking fees and material costs.

6. Warranties & Exclusions

  • Manufacturer Warranties: Synthetic turf and vinyl fencing products carry separate manufacturer warranties against UV degradation, excessive discoloration, cracking, or defects (ranging from 8 to 20+ years depending on product lines).

  • Workmanship Warranty: American Turf provides a limited workmanship warranty (as specified in your individual installation contract) covering seam integrity, fence post anchoring, base stability, and structural assembly.

  • Warranty Exclusions: Warranties do not cover damage caused by:

    • Reflective light melting on turf or vinyl fencing caused by energy-efficient Low-E windows or adjacent reflective surfaces.

    • Natural disasters, earth movement, soil erosion, earthquakes, or abnormal ground settling.

    • Physical abuse, severe animal destruction, vehicle impact, or unauthorized third-party modifications/repairs.

    • Exposure to harsh unapproved industrial chemicals, fire, or severe heat sources.

7. Intellectual Property & Website Use

All original text, images, project photos, branding, and graphics on americanturf.info are the exclusive property of American Turf and protected under applicable copyright and trademark laws. Unauthorized reproduction or commercial distribution is strictly prohibited.

8. Limitation of Liability

To the fullest extent permitted by California law, American Turf, its officers, employees, and subcontractors shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of this Site or services rendered. Our total aggregate liability under any agreement shall not exceed the total dollar amount paid by the client for the specific service or project in dispute.

9. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California. Any dispute, claim, or controversy arising out of or relating to these Terms, concrete/fencing/turf contracts, or services rendered shall be submitted to mediation or binding arbitration in San Diego County, California, prior to initiating court litigation.
